All Neotrope/DotComMojo services (as found on this and related websites) are subject to the following Terms of Service (TOS). You will be required to agree to these TOS on both the order form and on the project information form. If you don't agree to these TOS, you will not be able to order any of our keyword optimization and contextual marketing solutions.

The following TOS are subject to change. You should review the latest (current) version in effect as found on our secure order form.

TERMS AND CONDITIONS OF SERVICE (TOS) FOR NEOTROPE'S SEARCH ENGINE AND KEYWORD MARKETING SERVICES COLLECTIVELY KNOWN AS DOTCOMMOJO(TM), DOTSORCERER(TM), AND ALCHEMY POSITIONING(TM).

You agree that you are the authorized owner or representative for the website(s) you are asking us to submit to search engines and/or provide promotional services for; and further, that we are authorized to debit your credit card for the services you are requesting (if paying for service by credit card).

By providing access to your web server(s) and site content for the purposes of adding/modifying content in order to improve ranking potential, you agree to hold Neotrope and all personnel harmless against any claims of damage or availability of content over the Internet to content located on your server(s). While we will make all efforts to make back-up copies of any modified content, and will inform you in advance of any changes to be made (if any), we cannot guarantee that the content will be 100% available during changes. We are not responsible for ensuring that suitable prior backup copies of your original content are saved anyplace other than in a suitable "backup" folder on your server. Any content or digital files created or archived by Neotrope on our premises remain our exclusive property and you shall have no claim thereto.

Neotrope has no way of knowing if you have previously over-submitted a site or sites to specific search engines which may block your site for submitting too often. While we will work closely with you in an attempt to determine your status with such search engines and online databases, we make no guarantee against, and will not be held liable for, any blockage of your site by any or all search engines which have or which may enact such policies. Our proprietary internal system is designed to avoid this issue, however -- again -- we have no control over any actions taken or to be taken by an employee of yours, or any other company you have worked with, are working with, or shall work with which may adversely impact your rankings due to "over submission."

We do not offer our consulting services "on approval," or under a "trial program" of any kind. Orders may not be cancelled once placed, and no refunds will be provided under any circumstances. Since we will perform all services provided under this ageement, your credit card billing will not qualify for a chargeback (or "friendly fraud"), and we will dispute any and all attempts to perform any such action.

No warranty is expressed or implied, and we make no claims of suitability of our services for any purpose. Due to the nature of our consulting services to be provided, existing and emerging Internet technologies, domain name and search engine availability and changing policies and methods of listing sites by search engines and online databases, no guarantees are made as to effectiveness either intially or over time of our services.

You understand and acknowledge you are hiring Neotrope and its related companies as a consultancy, who will provide information and services based on our proven expertise; we are not delivering a software product, or tangible personal property of any kind, therefore there is no "return policy" in effect for our offerings.

Neotrope will remove links within our ContextEngine(tm) system to any web SITE which has commented html, hyperlinks, or textual urls listed for any other keyword optimization or SEO (search engine optimization), or search engine submission company. Neotrope will remove links within our ContextEngine(tm) system to any web PAGE which has links to any other keyword optimization company, or to any site that offers website design and marketing.

Neotrope does not provide services "anonymously." We will create announcements on various of our business sites which state that you have chosen our services for your optimization and website marketing, and we will have both temporary and permanent links into your content (including other pages than your home page), and we may use a screen shot of your website design in our featured client area. By ordering our services, you agree to allow us the limited right to reproduce your home page for the purpose of linking to you, and the right to deep-link into your content, and the limited right to use your business name and/or trademark(s) for this purpose. We make no claim to your content, or to your trademarks or service marks. Further, we include commented text in any HTML that we modify stating "Keyword Optimization Provided by Neotrope - www.neotrope.com" which is invisible to your site visitors, and which must remain in your modified HTML as long as we provide services for your firm. If these "credits" are removed, we may (at our sole descretion) choose to lower your site "weight" level within our ContextEngine(tm) system, which may lower your overall rankings over time. You are not required to provide a visible or invisible reciprocal link to our site/system from yours, however by doing so, we will provide your site additional "weight" in our system, to improve your permanent rankings.

All Neotrope service programs are for a specific period of time (i.e., 3 months, 12 months, etc.), as specified on our order form(s). Once a project expires, you will be invited to continue your program, but are under no obligation to do so.

We reserve the right to reject any project which involves illicit, illegal, or offensive content, or any company that directly competes with Neotrope.

Neotrope is not responsible for any local, state, federal, or "Internet" taxes related to the service ordered, or imposed before the end of the current tax year. Customer is solely responsible for any and all taxes which may be levied for this purchase from Neotrope.

You agree and understand that certain information to be provided to you by Neotrope will be considered proprietary and confidential and sharing this information with a competitor will be considered a breach of confidentiality, and may result in legal damages. Such information may contain written or verbal data related to improving your website, modifications to site content, articles and reports located in our members only area, and reports provided by email regarding your promotion campaign as prepared by Neotrope when applicable. By ordering our services you agree not to launch, or be directly involved with (ownership, consultant, or other position), any competing services substantially similar to those offering by Neotrope relating to search engine submission, keyword optimization, and website optimization for search engines for a period of not less than four (4) years. Any claimed breach of these provisions will be mediated in the County of Los Angeles, California, and will initially be mediated by the Better Business Bureau.

By submitting your order, and website information through our project form(s), you agree to be bound by these Terms and Conditions, per the laws of the United States of America, and the state of California.

IF YOU DO NOT AGREE TO THE FOREGOING TERMS AND CONDITIONS OF SERVICE (TOS), YOU MAY NOT ORDER SERVICES FROM NEOTROPE(R).
